The man accused of the 1996 murder of Tupac Shakur is seeking to have the charges against him dismissed. Duane “Keffe D” Davis filed this appeal with the Nevada Supreme Court on Tuesday after a lower court upheld the charges back in January.

Davis faces first-degree murder charges for his purported involvement in Shakur’s shooting death. He has entered a plea of not guilty and has been held without bail since his arrest in September 2023. In a recent interview with ABC News, Davis firmly stated, “I’m innocent. I ain’t killed nobody, never did ever kill nobody.” Despite his claims of innocence, Davis has drawn attention for seeming to confess in his memoir, *Compton Street Legend*, where he outlines the events surrounding Shakur’s murder.

### Challenges to the Case

In his initial motion to dismiss the charges in January, Davis’s attorney argued that his rights had been infringed upon due to a delay in prosecution that lasted 27 years, along with the assertion that immunity agreements had been granted. However, the district court judge rejected this appeal, citing a lack of evidence to support the existence of any immunity deals and stating that the delay was unintentional.

Prosecutors claim that Davis orchestrated the murder and supplied the firearm used in the incident. They argue that the shooting was a retaliatory act following a physical confrontation between Tupac Shakur and Davis’s nephew, Orlando Anderson, which took place after a Mike Tyson fight just hours before the shooting.

### Upcoming Trial Dates

Davis’s trial has been postponed until 2026 after his legal team filed for additional time to gather new witnesses and conduct further investigations. The new trial date is now set for February 2026.
