Prosecutors in the UK are challenging a recent judicial ruling that dismissed the terror-related charge against Kneecap’s Mo Chara. The Crown Prosecution Service (CPS) confirmed its decision on October 7, indicating a belief that there’s a significant point of law that requires clarification.

The case involves Liam Óg Ó hAnnaidh, known as Mo Chara, who faced charges after allegedly displaying a Hezbollah flag during a Kneecap concert in London in November 2024. The police were only made aware of the incident months later, in April 2025, following Kneecap’s controversial remarks about Israel and the situation in Gaza at Coachella.
Ó hAnnaidh’s legal team successfully argued that the charge was filed a day past the six-month limit, leading Judge Paul Goldspring to deem the prosecution “unlawful and null.”
### Kneecap’s Response
In reaction to the announcement of the appeal, Kneecap expressed that the move was expected but a significant misuse of resources. They criticized the process as being politically motivated rather than a genuine legal pursuit.
> “This is political policing. There is no ‘important point of law.’ The CPS has submitted nothing new in their appeal,” said the group, emphasizing their perspective on the situation.

While the CPS has not elaborated on its intention for the appeal, they previously claimed that the notice of the charge issued to Ó hAnnaidh was officially valid, despite lacking pre-authorization from the Attorney General until after the six-month timeframe had lapsed.
